These Terms and Conditions ("Terms") govern your use of the SuccesLab CRM platform ("Service"), operated by SuccesLab ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized access or breach

You are responsible for all activities that occur under your account.

4. Subscription and Payment

SuccesLab offers only paid plans.

Fees are charged monthly or annually as described on our pricing page.

Payments are processed securely via third-party providers.

Failure to pay may result in suspension or termination of your access.

All fees are non-refundable, unless stated otherwise.

5. Use of the Service

You agree not to:

Use the Service for unlawful or fraudulent purposes

Interfere with or disrupt the Service or servers

Reverse engineer or copy the platform's source code

Upload malicious software, spam, or violate data privacy laws

6. Intellectual Property

All intellectual property rights, including software, design, text, graphics, logos, and documentation, are owned by SuccesLab or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

7. Data Protection & Privacy

We process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided by you is accurate.

As a CRM system, you are the Data Controller for your end-user data. SuccesLab acts as a Data Processor and complies with GDPR regulations.

8. Service Availability

We aim to provide a 99.9% uptime. However, we do not guarantee uninterrupted service and are not liable for any downtime, loss of data, or service interruptions.

Maintenance or upgrades may require temporary suspension of the Service.

9. Termination

We may suspend or terminate your account at any time if:

• You breach these Terms
• Required payments are not made
• Your usage poses a security or legal risk

Upon termination:

• Your access will be revoked
• We may delete your data after 30 days
• Outstanding invoices remain payable

10. Limitation of Liability

To the fullest extent permitted by law, SuccesLab shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Data loss or corruption
• Loss of profits or business interruption

Our total liability shall not exceed the fees paid by you in the last 12 months.

11. Indemnification

You agree to indemnify and hold harmless SuccesLab and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Violation of these Terms
• Violation of applicable laws or third-party rights

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or the Service. Continued use after such changes constitutes acceptance.

13. Governing Law

These Terms are governed by Dutch law. Any disputes shall be submitted to the competent courts of the Netherlands.
